Business and Investment Visas
Business Owners and Investors who are well established with substantial interests can consider business migration. It does not have a points test. Senior Business Executives may have options where no state sponsorship is required.
STATE FLAG OF NEW SOUTH WALES
Investors achieving State Sponsorship (two stages)
To settle in Australia with state sponsorship an investor can be up to 55 years of age (English language capability is not a requirement) and obtain a provisional visa for 4 years and then apply further for permanent residence. The requirements are that the investor will settle and invest $AUD750,000 in a state treasury note or bond for 4 years and have personal and business assets of $AUD1,125,000 capable of being transferred with them to Australia within 2 years.
Without state sponsorship an age limit of 45 years applies, English is required and the financial aspects are doubled.
Business Owners achieving State Sponsorship
(two stages)
The entry point is for business people with an overall successful career...a business owner (part or whole, possibly several businesses).
Some the parameters where state sponsorship is available are:
Less than 55 years of age and there is no requirement to have English language capability.
Personal and business assets of over $AUD500,000, supported by valuations, capable of being transferred within 2 years.
Business owners have run a business with a turnover exceeding $AUD300,000. The interest in the business managed previously, where it is a publicly listed business can be 10%. But this percentage interest requirement increases to 30% where the turnover is at least $400,000 and to 51% where the turnover is less. The best two financial years in the four years immediately preceding application, are used to assess this.
Have also business plan for establishment of a business anywhere in the state within the next 4 years.
After 2 years and before the end of 4 years make a further application for permanent residence when the following is achieved:
Net assets in the Australian business of $AUD75,000
Annual turnover $AUD200,000
1 full time Australian employee
Without state sponsorship an age limit of 45 years applies, English is required and the financial thresholds are much increased.
This visa can be considered by those who have an overall successful business career and, further have negotiated the support of an Australian state government where they intend to reside. It doesn’t necessarily require a definitive business plan, but it does require demonstration of substantial consideration of the proposed business activity, that would be sufficient to cause the state government to support the application. For approval of this visa application there is a need for the business person to show they would be actively participating in Australia in the management of a new or existing business where they have a substantial ownership interest and further the business would benefit Australia. If over 54 years of age the state sponsoring needs to certify the exceptional economic benefit.
Specific parameters for the subclass 132 visa:
Personal and business assets in excess of $AUD1.5 million capable of being transferred within 2 years
Existing business has an annual turnover in excess of $AUD3 million in the main business
In 2 of the 4 previous fiscal years the net value of the assets (including the spouse if applicable) in a qualifying business was valued at $AUD400,000 and if a publicly listed company, a shareholding of at least 10% of the total issued capital
A qualifying business is one providing goods and services to the public, but excluding property rental. It excludes speculative or passive investment.
